Eliminating general causation: notes towards a new theory of justice and toxic torts

Article Abstract:

The causation model of liability in toxic tort cases is a failure from deterrence and compensation standpoints and should be replaced by a system imposing liability for failure to develop and disclose necessary information. This replacement system would require cost-effective scientific studies of latent risks of products and public disclosure of results. Such a system encourages and rewards responsible corporate behavior.

On causation

Article Abstract:

The author argues that tort law's focus on maintaining society's economic system perpetuates social harms and proposes two solutions: that tort liability be expanded to consider and redress social harm, and changing the concept of responsibility from being egocentric to communal.
