Interracial violence and racialized narratives: discovering the road less traveled

Article Abstract:

Ethical restrictions on the use of racialized narratives of "black deviance" by criminal defense attorneys should not be restricted on the basis of arguments made in the Reginald Denny beating case. Along with being constitutionally suspect as a violation of the First and Sixth Amendments, the proposal offers a legal remedy for a much broader social problem. Perceptions of race, deviance and defiance pervade media and the criminal justice system and are implicated in many criminal trials, including white-on-black violence cases, and only a more fundamental ethical commitment will have any influence.

Race-ing legal ethics

Article Abstract:

Ethical responsibility for criminal defense attorneys and their clients for using race-based narratives is not intended to limit the attorney's capacity to mount a defense but is intended to integrate moral accountability into the lawyer's role. Such a measure is needed to counter problems with both black deviance and white defiance narratives. Departing from moral nonaccountability will better serve to infuse criminal defense with collectivity, contingency and race-consciousness principles.

The integration game

Article Abstract:

The authors examine homeowner preferences and distortional incentives in the housing market which tend to perpetuate segregation in the US. They suggest four measures to combat such barriers to housing integration: home-equity insurance, realty sales taxes, institutional subsidies, and growth controls.
