Employer's liability for employee's criminal or other wrongful act: the tort of negligent hiring

Article Abstract:

Negligent hiring cases, which are becoming more commonplace, generally involve claims of employer liability for an employee's tortious act if the employer had knowledge of the employee's potential to injure others. The theory holds employers responsible for acts committed outside the scope of employment, thereby distinguishing negligent hiring from respondeat superior; it is also distinguishable from negligent retention. However, this tort does not have a clear constitutional basis and it undermines the established notion of proximate cause.

Reducing insurer liability for conducting fraud investigations

Article Abstract:

Insurance companies should carefully set up guideline for the investigation of insurance fraud claims, keeping in mind the possible tort liability arising from such investigations. The industry can receive statutory grants of immunity for investigative tactics, however, in many states. This involves creating a coherent policy for investigative practices that are used only to combat fraud.
