Enterprise bargaining, managerial prerogative and the protection of workers' rights: An argument on the role of law and regulatory strategy in Australia under the Workplace Relations Act 1996 (Cth)

Article Abstract:

The changing role of the institutions, which regulate Australian industrial relations, is explored. It is concluded that a shift is occurring in Australian labor law from a mixture of self-regulation and centralized 'command and control,' to 'enforced self-regulation,' thus signaling a systematic and far-reaching regulatory policy and technique in Australian market regulation.

Some problems and themes in the application in Member States of Directive 2001/23/EC on transfer of undertakings

EU Directive on laws of member states to protect the employee rights on the advent of transfer of undertakings is examined. Labor laws of particularly the U.K. and Ireland are being reviewed.
