Ethics advisers watch over firms

Article Abstract:

Law firms are well advised to have in-house ethical specialists, as this can greatly diminish the chance of malpractice claims. These specialists must be readily available to research and answer on-the-spot questions and also be interested in developing preventive law strategies for the firm. They can help the firm minimize malpractice charges and plan for the future while taking ethical implications into consideration. Making consultations with an in-house ethics lawyer voluntary will not diminish the effectiveness of the program.

The right way to take clients when moving on

Article Abstract:

Attorneys who have decided to leave their law firm and want to take some clients with them must be careful to avoid discipline with honesty and ethical behavior. Attorneys have substantive duties to their employers and must follow firm procedures in starting new files. If the jurisdiction's rules permit solicitation of former clients, this can be done, but clients cannot be subjected to undue influence.

Overbilling is a losing proposition

Article Abstract:

Attorney overbilling complaints come both from private clients and from corporate counsel who feel that outside counsel have submitted excessive bills. Overbilling is an ethical violation and it is a breach of ethics to charge more than a client agreed to. Disputes about fee agreements are usually resolved against the lawyer.
