Ethics and the attorney as mediator or third party neutral

The author discusses efforts to revise the Uniform Mediation Act, ethics issues confronting third-party neutrals, and the role of attorneys as third-party neutrals. Topics include the question of whether alternative dispute resolution methods constitute the practice of law.

Charitable foundations in corporate reorganizations: insurers can learn from the thrift industry

Article Abstract:

The advantages of applying the structure of charitable foundations to insurance company corporate reorganizations are outlined. The drawbacks of creating a charitable foundation by demutualizing/reorganizing insurers are also discussed.

The rationale for the admissibility of the American Bar Association's Model Rules of Professional Conduct as evidence of attorney malpractice is discussed, along with the circumstances under which the Model Rules are admissible.
