FCC gains upper hand over local telephone companies; a recent high court decision and an FCC order on ISPs uphold the FCC's regulatory primacy over local telecommunications

Article Abstract:

The Supreme Court's ruling in AT&T Corp. v. Iowa Utilities Board upheld the power of the Federal Communications Commission (FCC) to regulate intrastate telecommunications service in furtherance of the local competition goals of the Telecommunications Act of 1996. A month after that, the FCC issued a declaratory order concerning payment between phone companies for carriage of dial-up Internet traffic. Both rulings uphold FCC regulatory primacy even over local telecommunications.

Financial community fixes on online data privacy; as e-commerce becomes more global, U.S. privacy legislation should follow Europe's lead

Article Abstract:

Issues regarding data privacy in electronic commerce are discussed. Because the Internet has no boundaries and privacy law is different in every country, US business must comply with the privacy laws of other nations, primarily the European Privacy Directive. Data privacy protection can distinguish a business from its competitors and shield it from potential liability.

Local telephone competition remains a big issue; search for a solution as much on the table as when 1996 act was enacted

Article Abstract:

Recent court rulings challenging regulations to local competition regulations. Potentially broad facilities-based competition is under either the Bell operating companies or wireless operators, as both still own their networks. Competition to provide local telephone service mainly exists among the Bell operating companies.
