Article Abstract:

The search-and-seizure guidelines as they apply to searches of computers are discussed. Why computer searches have become more common and how to minimize the risk posed by such a search is also detailed.

Issues arising with electronic discovery are discussed, and include tracking the sources of such information, authenticating such evidence, and pitfalls such as the danger of inadvertent waiver. In addition to the personal computer and server hard drives, such sources can include the meta data, the network backup tapes, the Internet server and visitor data, and even deleted files

Finding the smoking gun electronically; to be successful, litigators must search for critical data buried in computer hard drives, e-mail and e-business records

Article Abstract:

Today's need to see electronic records including e-mail as important evidence and even to search for evidence on a computer's hard drive is discussed. Technology experts can use special software tools to ferret out the existence and extractability in the opponents repositories.
