TWA 800 crash case gets a boost; design defect is best theory with bombing discounted

Article Abstract:

The federal agencies investigating the cause of the 1996 TWA Flight 800 disaster seem to have achieved the consensus by mid-1997 that the tragedy was not caused by a criminal act. The National Transportation Safety Board and the FBI have, however, not determined what technical defect caused the explosion. The mechanical failure theory lets plaintiffs file a relatively straightforward products liability action against Boeing, but the case against Boeing is complicated by matters such as Warsaw Convention limits on damages unless plaintiffs have evidence of wilful misconduct.
