HIV/AIDS in the courts in the 1990s

Article Abstract:

More than 550 AIDS-related cases filed in both federal and state courts were analyzed to elucidate the apprehensions and misconceptions regarding the disease and to facilitate the drafting of better policies. The analysis revealed that a great number of judicial opinions did not distinguish between remote and significant risks of transmission. Despite the court's upholding of scientific opinions, they may be prone to expert testimonies that are not well-substantiated by scientific researches.

The AIDS Litigation Project: HIV/AIDS in the courts in the 1990s, part 2

Article Abstract:

A study was conducted to examine the rights of HIV patients over the interests of other individuals or the government. The study, which was entitled the AIDS Litigation Project, reviewed several cases involving HIV-positive individuals with regards to government legislations such as the Americans with Disabilities Act of 1990. Results revealed that the government has been exerting efforts to undermine the social impact of HIV/AIDS and uplift the rights of AIDS patients.

Self-incrimination, partner notification, and the criminal law: Negatives for the CDC's "Prevention for Positives" initiative

Article Abstract:

The Centers for Disease Control and Prevention (CDC) announced a new HIV prevention initiative, "Prevention for Positives" on 18 April 2003, which emphasizes partner-notification activities for individuals who are diagnosed with HIV. The proposed partner notification activities involve patients' voluntary identification of contacts at risk for HIV transmission.
