He says, she thinks

Article Abstract:

The attempt to stop gender-specific harassment in the legal profession through Rules of Professional Conduct amendments is complicated by the lack of a clear definition of what constitutes harassment. The issue is truly gender specific in that men do not recognize certain actions as harassment in tense situations while women respond to them as harassment. Attorneys are consistently meeting in tense situations, further acerbating the problem. Therefore, a clear analysis of the socio-cultural underpinnings of gender-specific harassment needs to be made to write understandable rules.

All value isn't billable

Article Abstract:

The tradition of overstaffing cases to increase profits is no longer acceptable because the practice of law has become a business rather than a profession. Overstaffing benefits law firms in that less experienced lawyers can learn from supervised work as well as from observing more experienced lawyers. However, only work that can be shown as productive is billable to the client. This new evaluation of lawyers' time is complicated because new lawyers can provide forgotten information or new perspectives while experienced lawyers can learn from new situations.

Not snow, nor sleet, nor gadget boom will kill the billable hour

Article Abstract:

The billable hour seems sure to live on in law firms despite modern tools such as Attorney Total Office Management (TOM) which use a task-based billing method. Besides including the ABA's task-based billing codes the system has many components: file and document management, calendars, and even an automatic telephone dialer. Richard C Reed, author of books on alternative fees, finds some movement towards their use but hourly billing still favored.
