High court punts on equivalents; long-awaited patent case bounced back to lower court

Article Abstract:

The US Supreme Court remanded Warner-Jenkinson Co v. Hilton David Chemical Co to a lower court, declining to rule on whether courts will decide questions of equivalence and which linguistic framework they should use in that decision. The case brought many amicus briefs on both sides. It involved a filtration process for removing dye impurities. A trial court found Warner-Jenkinson guilty of infringement, the US Court of Appeals for the Federal Circuit affirmed this verdict, and the Supreme Court granted certiorari.

Fertile fields of litigation; did power-line radiation cause cancer?

Article Abstract:

Zuidema v San Diego Power & Electric Co, in trial in a California court, is the first personal injury case involving electromagnetic field radiation levels. The case alleges that these high radiation levels changed the cell growth patterns of the fetus which became Mallory Zuidema and subsequently caused kidney cancer in the five-year old girl.
