Hollow victory: toxic waste suits expose laws' strengths, flaws

Article Abstract:

Citizens' efforts to fight hazardous waste dumping at Four County Landfill in Delong, IN, have been successful in closing the site but not in getting it cleaned up. A lawsuit against landfill operator Environmental Waste Control resulted in the closure, but the company filed for bankruptcy, thereby obtaining a stay of cleanup and legal costs. The citizens group has sued another company linked to the landfill, The Heritage Group, for cleanup costs. The government has begun the Superfund cleanup process.

A toxic refuge; fleeing to the suburbs, they landed on a dump

Article Abstract:

Families who left New York City to buy their first homes in suburban Haverstraw, NY, now know that their homes stand on an industrial landfill and that the gypsum board rotting underground is releasing hydrogen sulfide gas. The mostly black and Hispanic residents are taking the community and the Carpenters' Pension Fund which funded the development to court. Problems include the odor which pervades the area, the unsaleable homes and the variety of unexplained illnesses residents suffer from.

Firm backed in a bitter waste case

Article Abstract:

A criminal complaint has been filed against the San Francisco law firm of Sullivan, Roche and Johnson under California environmental law, the first time a law firm has been criminally charged for giving advice. The firm represented InFerGene Co, a medical testing company that allegedly left hazardous wastes in its rented laboratories. The state's largest law firm, Gibson, Dunn & Crutcher, has filed an amicus brief charging that the case threatens the independence of the legal profession.
