How much is too much? Primer for testing the limits of lawful assistance to a union organizing effort

Article Abstract:

The National Labor Relations Board (NLRB) has outlined three steps for prudent employers to take when they have chosen not to resist union efforts to organize their employees. The steps include a minimal amount of pre-recognition assistance, no comments about the union to employees and a non-accommodating posture to union representatives at the time of their organizational meeting for the employees.

Article Abstract:

Lechmere, Inc v NLRB made an unfair situation worse in the decision's denial of union organizer access to employer premises during an organizing campaign. The court declined to balance employer property rights and employee rights mandated by the National Labor Relations Act. Exclusion of union organizers accomplishes nothing other than frustrating worker-union communication.
