"In such manner as the legislature thereof may direct": the outcome in Bush v. Gore defended

Article Abstract:

The author argues that the US Supreme Court's Bush v. Gore decision was valid in light of the mistakes of the Florida Supreme Court. Topics include the case's equal protection challenge to Florida's vote recount procedures and the requirement of the US Constitution that Florida appoint its presidential electors.

Bush v. Gore: What were they thinking?

Article Abstract:

The author contends that the US Supreme Court majority in Bush v. Gore acted out of a belief that the Florida Supreme Court had to be prevented from awarding the 2000 election victory to Al Gore. The author argues further that the federal court engaged in a form of unjustified civil disobedience.
