Intergovernmental compacts in Native American law: models for expanded usage

Article Abstract:

Compacts between Native American tribal governments and state governments could settle some of their jurisdictional and substantive disagreements. Intergovernmental compacts have become more important because of the expense of litigation, the large number of tribes, the primary role of the states in relation to Native Americans, and the desire of Native Americans to define their sovereignty. Model compacts could allow effective dispute resolution in such areas as social services, economics, and conservation.

There is a widely held belief that the federal government is more responsive to environmental concerns than the states. However, evidence does not support this conclusion.
