International Centre for Settlement of Investment Disputes: Award of the Tribunal

Article Abstract:

The proceedings of ADC Affiliate Limited and ADC & ADMC Management Limited as claimants and The Republic of Hungary as the respondent about an alleged unlawful expropriation by the respondent of the investment of the claimants in and related to the Budapest-Ferihegy International Airport are presented. The tribunal awarded that the respondent shall pay the claimants sum and interest towards the transfer of ownership of its projects and towards costs and expenses of arbitration, and claimant to transfer the ownership thereafter.

Article Abstract:

The proceedings between World Duty Free Company Ltd. and The Republic of Kenya, involving bribe to bag the contract for the construction, maintenance and operation of duty free complexes, is presented. The tribunal decided that the claim advanced by World Duty Free Limited is dismissed, both shall bear in full their respective legal costs and half of arbitration costs will be born by each without recovery from the other party.
