Inventions abroad warrant careful contracting; companies need to be aware of local laws and use contracts to determine ownership clearly

Article Abstract:

A patent lawyer faces difficult choice-of-law issues when advising a company which operates both in the US and abroad, and countries tend to have widely varying laws dealing with the employer-employee relationship with respect to the ownership of inventions. Knowing the law of the country where the business will operate is thus crucial, and after becoming familiar with this law the employment contract should be drafted so as to detail the rights of the parties with regard to inventions.

Buyer beware: a cross-license may still be lurking; the 'Intergraph' case is a warning for companies to keep track of IP rikghts conveyed

Article Abstract:

Issues are discussed regarding the cross-license, sometimes entered into between two companies with overlapping technology rights as a way of avoiding conrflict. Intergraph Corp. v. Intel Corp. is discussed at some length, in which Intel based its defense to a patent infringement suit on a cross-license agreement.

'Intel' case illustrates the perils of cross-licenses; patent holders should clearly define scope of patent, extent of licenses

Article Abstract:

The importance of care in the design of a corporation's cross-licensing agreements and awareness of possible adverse property effects is discussed. The 3d Circuit ruling in Intergraph Corp. v. Intel Corp. on this issue is discussed.
