Privacy or creditors: who holds the trump? E-bankruptcies raise question of destiny of data assets

Article Abstract:

Whether privacy concerns come before creditors' rights in the bankruptcies of dot-com companies is discussed. Value in such bankruptcies is a combination of three new factors, usiness models, technology and the ever-changing legal rules of the electronic commerce environment.

Web privacy; FTC takes action

Article Abstract:

The bankruptcy of many Internet businesses as it highlights the conflict between protecting the privacy of electronic commerce users and maximizing the debtor's assets is discussed. Bankrupt businesses regard their customer lists and profiles as valuable assets, but as viable businesses they guaranteed customers that such information would remain private.

'Markman' precedent holds up patents; ruling intended to add predictability and speed fails to do so

Article Abstract:

!The ramifications of the US Court of Appeals for the Federal Circuit's high reversal rates of trial court judges on Markman issues are discussed. Markman v. Westview Instruments, a 1996 Supreme Court ruling, stated that judges rather than jurors are better suited to interpret complex patent claims.
