Is 'team raiding' misappropriation? Wal-Mart claims Amazon.com obtained its trade secrets by hiring skilled retail employees

Article Abstract:

A suit by Wal-Mart against Amazon.com used the inevitable disclosure doctrine in its claim that employees hired away by the on-line bookseller were bound to reveal the trade secrets of a former employer when they took another position in a similar field or on a similar product. The doctrine operates independently of the covenant not to compete. The Wal-Mart employee in question, also a defendant in the suit, had worked as Wal-Mart's chief information officer, a position he also took with Amazon.com.

Section 337 of the Tariff Act of 1930, providing expedited relief to US patent holders to prevent the importation of patented goods, and the International Trade Commission, the agency with sole authority to determine alleged violations of the law, are discussed.

Article Abstract:

The frequency of requests for emergency injunctions in computer industry litigation is discussed. The disclosure of a trade secret could quickly become a multi-million dollar loss, and speed can be of the essence.
