Article Abstract:

Personal injuries common to summer could take the name of backyard torts, and these lawsuits arising from popular summertime activities have key issues including the duty of the homeowner or host to other parties, the obviousness of the danger, and whether the injured plaintiff assumed some risk. As is true with other cases of premises liability, courts start by examining the relationship between plaintiff and defendant/property owner. From this relationship, state law defines what duty the property owner owed the plaintiff. The law on backyard torts will vary from state to state.
