Keeping tenants out of the cold; local, state and federal laws offer defenses against eviction actions

Article Abstract:

Tenant rights under state, local, and federal law can serve as successful defenses to eviction actions, but most tenants will need help asserting these defenses. Lawyers representing tenants facing eviction should start by obtaining every document related to the tenancy and, after determine from these documents which laws apply. In developing a defense, it is helpful to remember that most of the laws governing landlord-tenant relations are local, so defenses available to residents of one part of the US may not be open to those of another.

Yard work; Harvard Law revives mandatory pro bono debate

Article Abstract:

Issues regarding the mandatory pro bono debate are discussed. The 1997 Ass'n of American Law Schools (AALS) survey on the status of law school public service programs concluded that law schools should do more, and the AALS has consulted with law schools on how to improve their public service programs. The controversy regarding Hardvard Law School's mandatory pro bono program is discussed.

Doing well by doing good

Article Abstract:

Reported declines in pro bono legal services are discussed and various possibilities described. These include representing political refugees seeking asylum, handling adoptions, and representing consumers in small cases. ABA Model Rule of Professional Conduct 6.1 deals with voluntary pro bono service and ethics rules recognize the lawyer's duty to volunteer.
