Merrill: keep grand jury confidential; firm fights evidence release in Orange County matter

Article Abstract:

Lawyers are concerned that a California appellate court's approving the public disclosure of grand jury testimony on Merrill Lynch's role in the 1994 Orange County, CA, investment fiasco could undermine the long-standing practice of trying to use negotiation to forestall an indictment in economic crimes. California's, and indeed the criminal codes of most states, generally keeps state grand jury proceedings confidential. California's statute is silent on whether trial judges can release testimony when there is a pre-indictment settlement.

Big risk for GM in ad suit; spat with dealers could affect some non-auto franchises

Article Abstract:

Midwestern General Motors dealers have filed a suit against the corporation challenging their cutting off funding for the advertising traditionally put together by local dealers and replacing these with regional advertising campaigns. Observers say the suit is of interest to other franchise-based industries that are thinking of changing to regional advertising campaigns financed by local franchise contributions.
