Minimum standards for private adjudicators?

Article Abstract:

The end result of private arbitrator training should be demonstrated competency in basic substantive and procedural legal concepts, knowledge of basic ethical laws applicable to arbitration, minimum experience in the adversary legal system, substantial knowledge and experience of the subject area in dispute, and demonstrated ability to write a decision. Continuing educational requirements and performance evaluations will ensure continuing competency.

Conflict resolution in America's schools: defusing an approaching crisis

Article Abstract:

Peer mediation in the K-12 school system can help resolve immediate problems as well as provide children with conflict resolution skills they can use in the future. Violence in schools reveals a need for conflict resolution procedures. Training can teach students how to respect others, listen to disputants' claims, communicate effectively, and maintain confidentiality.

Adversarial or conciliatory: what litigators should know about mediation

Article Abstract:

Attorneys who act as mediators need different skills than those used as litigators. Litigators defend one position by appealing to emotions and marshalling evidence to showcase a client's strengths and hide weaknesses. Mediators bring two opposing positions to agreement by participating in the interests of all parties.
