Make it habit-forming: effective cross-exam takes practice, practice, practice

Article Abstract:

Attorneys can be successful at cross-examination if they constantly and continuously practice a few fundamental cross-examination skills. They should practice asking only leading questions, short questions, using simple words and avoiding introductions and tag endings. Lawyers should practice using headlines, asking for one fact at a time and avoiding all opinions.

Misdirect, then pounce; don't always let witnesses know where you are taking them

Article Abstract:

Trial lawyers should remember in doing their cross-examination that they are the witness telling the story omitted in the direct examination. Their questions should proceed in an orderly fashion so the story line can be easily followed, and practicing telling stories using cross-examination questions can be a big help. These practice questions should not have the automatic "isn't it a fact" introductions and isn't that so endings."
