Patent law; e-commerce damages awards

Article Abstract:

The importance the patentability of Internet business methods has assumed is discussed, even though various commentators have raised questions about such patentability.The combination of the dubious nature of the business method patents, the need to protect the first-mover advantage, and little threat of an adverse damages award tend to result in much litigation.

'No trespassing': Internet spin on an old doctrine; the 'eBay' court maintained legal borders on the Net with traditional property concepts instead of using IP protection

Article Abstract:

Issues regarding business method patents are discussed and the inability of traditional patent law to establish high enough borders to protect electronic commerce companies is claimed. Case law discussed starts with the landmark 1998 State Street case and includes a detailed discussion of eBay, Inc. v. Bidder's Edge, Inc., decided in 2000 by a federal district court.

Issues regarding Internet or business method patents are discussed, focusing on Amazon.com's suit against Barnesandnoble.com for infringement of its 1-Click patent. Congress proposed legislation in this area and the Patent and Trademark Office instituted a business methnod patent initiative.
