Panel issues report on judicial selection gridlock

Article Abstract:

A bipartisan commission has urged that judicial selection be streamlined by measures including the use of recess appointments by the president. The commission was in favor of continuing use of the ABA to evalate judicial candidates' competence, but suggested that the organization add more members to its Standing Committee on the Federal Judiciary to streamline matters and give a short explanation of reasons for its ratings. The commission blamed the nomination process for the delay in filling federal judicial vacancies.

The high court's center falls apart: closer votes last term reveal splintering in a moderate coalition

Article Abstract:

The Supreme Court's decisions for the 1992-93 term reflect the conservative nature of the high court justices. In the court's 5-4 decisions, David Souter tended to be in the minority while the arch-conservatives were on the majority side, a sign that the court's conservatism is not limited to a single theoretical view. Conservatives tended to get their way in all close decisions for the term. One of the most interesting developments of the term was Souter's increasingly vocal opinions.

A rare consensus and clear conservatism characterized the court's 1997-98 term

Article Abstract:

The hallmark of the 1997-98 Supreme Court term were the discrimination rulings, setting clear standards for courts and parties in sexual harassment and disability litigation.The court's actual workload, while down in numbers of key controversies, was up in numbers from the year before, 91 decisions in 1997-98 as opposed to 80 the year before. Decisions were also marked by a high degree of unanimity and, in the criminal law area, adding to a long line of conservative cases.
