Panel proposes class action changes

Article Abstract:

The federal Advisory Panel on Civil Rules has proposed changes to the procedures followed in class action certification rulings that include requiring judges to engage in cost-benefit analysis when making certification decisions. An earlier proposal had suggested that judges weigh the merits of the case at the certification stage. The Panel also proposes that direct appeals of certification decisions to the circuit courts be allowed without the trial judge's involvement. Plaintiffs attorney Elizabeth J. Cabraser is opposed to both proposals.

Some lawyers balk at lobbying limits for Clinton officials

Article Abstract:

Bill Clinton's campaign promise to require departing government officials to refrain from lobbying their former agencies for five years may decrease the number of candidates. Tax or securities lawyers whose work necessitates contact with government agencies in charge of these areas may be particularly reluctant to apply. Applications are most likely to decrease below Cabinet and White House staff levels.
