Copyright law; visual artists' rights

Article Abstract:

Issues regarding the Visual Artists Rights Act of 1990 (VARA) and some practical pointers regarding that federal law are discussed. VARA adds three new rights to the copyright law: the right of integrity, the right of attribution, and the right to prevent the destruction of copies of works of visual art possessing recognized stature.

Domain names; property status

Article Abstract:

The cases ruling on the property status of domain names are discussed, and although qualifying as property under federal anti-cybersquatting legislation, they fail to qualify under certain state laws for garnishment proceedings or tort claims for conversion.

Patent pools, cross licenses draw antitrust scrutiny; DOJ, however, is demonstrating consistency in its approach and flexibility in two review letters

Article Abstract:

The Department of Justice's Antitrust Div. has devoted more attention to cross-licensing and patent pooling, even though the department believes that most of these practices are pro-competitive. Cross licenses between firms that are competitors are more likely to produce the anticompetitive consequences, and can include price increases, production cutbacks and reduced innovation. Federal antitrust enforcement agencies using a "rule of reason" test to analyze these patent arrangements look closely to how they affect innovation.
