Patterns of ADR use in corporate disputes

Article Abstract:

Corporations were surveyed on the use of alternative dispute resolution (ADR) in the form of mediation or arbitration to settle disputes with other corporations. Eighty-seven percent used mediation at least once in the past three years, while 80% used arbitration. Persistence of use is uneven, with 43% using mediation only occasionally. The data suggest that corporations reserve ADR for particular kinds of disputes. The cost of litigation is the principal reason for resorting to ADR.

Y2K & ADR: get ready for midnight

Article Abstract:

The Year 2000 (Y2K) computer compliance problem will create a range of liability issues that can be settled by mediation and arbitration. Issues can include claims made by software and hardware vendors, statutory causes of action based on fraud and unfair business practice, intellectual property, conflicts between insurers and insureds, and conflicts between loan recipients and banks. The American Arbitration Association has issued a draft dispute resolution program for Y2K claims.
