Protection of trademarks calls for proper procedure; domain name disputes need be approached with a thorough and well-thought-out plan

Article Abstract:

The risks posed by the strength of a client's trademark and business identity on the Internet reqyure attorneys to analyze the evidence in domain name disputes thoroughly.The first step is establishing the identities of the domain name registrant and the parties to contact for administrative, technical and billing issues, and can be found by a search of www.networksolutions.com. Network Solutions Inc. has since 1993 provided domain name registration services in the .com, .net, and .org domains. NSI also has a Domain Name Dispute Policy. Other NSI services are listed.

Article Abstract:

Trademark rights' basis in geography complicates the unsettled area of Internet domain name law. Porsche Cars North America, Inc. v. Porsch.com is important because it could establish a US forum for hearing domain name issues. Porsche was brought not against the individuals who registered the names but against the domain names themselves. As an in rem action, Porsche was filed where the property was located, here in the Eastern District of Virginia, home of Network Solutions Inc, the domain names registrar.

When search words lead to competing Internet ads; as long as Web surfers are not confused, a banner ad can be keyed to competitor's mark

Article Abstract:

The possible use of a competitor's trademark to trigger an Internet banner ad is discussed. As long as it is not confusing, such use is not illegal.
