Recent attorneys general have made it hard for independent counsels to function

Article Abstract:

The US Department of Justice's reputation has for various reasons been negatively affected, and the start of the Clinton administration is a good time to evaluate the Department and the pros and cons of reauthorization of the Office of Independent Counsel. The independent counsel was created for those situations when the attorney general's duty of loyalty to the president conflicts with the duty to enforce the country's laws. The president's opposition to the independent counsel has rendered the office ineffective when used and now is the time to reevaluate.

The sentencing guidelines ignore the welfare of female defendants' children

Article Abstract:

Federal Judge Jack B. Weinstein of the Eastern District of New York is one of a growing number of judges and scholars who doubt the gender neutrality of the sentencing guidelines. They think that perhaps a female offender should have alternatives to long prison sentences since she is often her children's sole support. At present, judges need a prosecutorial motion affirming a defendant's 'substantial assistance' before they can impose a lesser sentence than the guidelines specify, which puts sentencing under the control of prosecutors rather than judges.

Prosecutors have used criminal statutes to deter others from spreading AIDS

Article Abstract:

The furor over Edward Savitz, an AIDS carrier that paid for sexual favors from Philadelphia minors, should be a signal that public health policy needs to be updated to deal with AIDS. The panic resulted from Savitz's admission that he was an AIDS carrier, and the realization of the potential effect on the populace. This all happened despite Savitz's declarations that he insisted on condom use by his partners. Were AIDS to be treated like other sexually transmitted diseases, this panic would not have occurred.
