Red tape slows setup of China joint ventures: mastering the first stages of establishing a joint venture is essential to avoiding pitfalls

Article Abstract:

Many joint ventures in China lead to litigation or arbitration, often because the government's strict guidelines are not followed or changes in the legal and political climate elude the partners. Common errors include not getting the proper authorities' approval, disproportionately valuing technology transfer, and misconstruing the nature of the contracting process. The first step is to sign a letter of intent, prior to beginning contract negotiations; this must be approved by local or national bodies, depending on the project's value.

Federal appellate courts are split on how to treat plaintiffs with chronic health conditions that can be mitigated, under the Americans with Disabilities Act

Article Abstract:

Federal appellate court rulings disagree about the proper Americans with Disabilities Act treatment of plaintiffs with chronic illnesses which can be mitigated, and these rulings seem to indicate that employees who control medical conditions with mitigating measures are only disabled if the condition still significantly restricts a major life activity of the employee. Given the disagreements among the circuits the issue appears to be headed for the US Supreme Court.
