Ruling affects rights of support contractors; maintenance is held to infringe a copyright

Article Abstract:

The 9th Circuit ruled in MAI Systems Corp v. Peak Computer Inc that an independent computer maintenance firm had infringed a copyright by servicing users of Peak Computer Inc hardware and software. MAI maintained that in servicing its machines, Peak operated copyrighted software licensed only to MAI customers. The court agreed that an infringement had occurred since Peak had no license rights to maintain MAI systems. Independent service companies should in the future obtain direct license rights to avoid infringement, but they have little protection from excessive charges by copyright owners.

Metasites linking to IP violations; Web sites framed or linked to other sites may enjoy greater exposure, but some are suing the framing sites for infringement

Article Abstract:

The practice of framing Web sites as part of linking sites into metasites has come under fire as a form of copyright infringement and misappropriation. An initial site's framing of linked sites can allegedly lead to loss of advertising control and value, as well as trademark dilution. The Ticketmaster-Microsoft linking case and the Total News framing case are profiled and analyzed.
