Talking impeachment hypotheticals

Article Abstract:

Members of the House Judiciary Subcommittee on the Constitution used impeachment hypotheticals to question law professors and historians in considering whether Pres Bill Clinton should be impeached. The wording of the draft article of impeachment distributed by Rep Robert L Barr, Clinton's strongest antagonist, was lifted from that used against former Pres Nixon. Barr equated Clinton's guilt with Nixon's, with the exception that he did not misuse the CIA in his efforts to obstruct justice. Prof Laurence Tribe disagreed, explaining that an impeachable offense must involve the misuse of quintessentially presidential powers.

No matter what, Ken Starr may get the last word

Article Abstract:

Special Prosecutor Kenneth Starr could indict Pres Bill Clinton on grand jury perjury or obstruction of justice after the president's term ends in Jan 2001 and thus Clinton's major demand in any sort of "plea" agreement leaving him in office would be immunity from future prosecution. As the independent counsel is a constitutional anomaly, senators' only bargaining chip in striking such a deal would be sheer persuasion.
