NCAA's lawyer is tops on the court

Article Abstract:

Elsa Kircher Cole, the general counsel of the National Collegiate Athletic Association, a well-known nonprofit association of the institutions of higher education engaged in intercollegiate sports,heads a legal department of just two people, including herself. A high-profile 1999 win consisted in the 3d Circuit staying a lower court ruling barring the NCAA from using minimum SAT scores in deciding whether a freshman qualified for a team.

Lawyer fraud gets a pass; bar authorities may not punish if 'benign fraud' is for client

Article Abstract:

Benign fraud is lawyer fraud for the benefit of a client and is often not punished by state attorney discipline commissions, but ethics experts state that such decisions send the wrong message to attorneys families plead to break the rules. "Medicaid planning," or asset transfer so that the elderly would qualify for state nursing home assistance, was a common example of such cases in the early 1990s.
