Taxman at poor's door; lawyers' help proves crucial for migrants when IRS audits

Article Abstract:

The article discusses the earned income tax credit (EITC) and the problems it causes for migrant workers who do not qualify because they live apart from their family for most of the year and wind up using tax preparers not knowledgeable enough who routinely claim the EITC for them. The agency often disallows legitimate EITC claims and even dependency exemptions which even workers living apart from their children most of the time qualify for.

Greg Ferenbach, the senior vice pres and general counsel for the Public Broadcasting Service (PBS), a nonprofit corporation serving 350 public television stations through program distribution and various educational services with a budget of approximately $250 mil and reaching about 100 mil viewers weekly, heads a department of just eight lawyers. Ferenbach believes in training the legal staff to adapt to a more entrepreneurial PBS.

Both the federal government and consumer advocates have attacked the company for potential right-to-privacy violations. The lawyers are also involved in product development for the company and advise customers on privacy.
