Telling remarks; informing insurer can also feed discoverable data to plaintiff's counsel

Article Abstract:

Issues are discussed concerning the discoverability of applications for legal malpractice insurance and communication between a lawyer and insurer concerning a claim. Some states protect such information as part of the insurer-insured relationship, while to others it is merely communication regarding a contract.

Digital discovery grab bag; with expanding federal rules, lawyers have to get a handle on e-files

Article Abstract:

The imminent expansion of federal discovery rules and its effect on electronic discovery is discussed. Computer companies involved in litigation worry about inadvertent disclosure of trade secrets. Guidelines for electronic discovery are given.

Lawyers just want to have funds

Article Abstract:

Some problems that can emerge with third-party funds deposited in law firm trust accounts are described. Legal professional liability insurers may not cover bad check losses, so insisting on wired funds is always safer.
