The Constitution in Congress: the Third Congress, 1793-1795

Article Abstract:

The legislative activities, as well as the actions of Pres Washington, during the Third Congress from 1793 to 1795 are able to shed light on the way the Constitution was perceived and interpreted. The issues addressed included the 11th Amendment, the presidential power to declare peace, Congressional war powers, St. Domingo refugees, removing a incompetent judge, naturalization laws, and the seating of a territorial delegate to Congress.

Rumors of wars: presidential and congressional war powers, 1809-1829

Article Abstract:

The author examines the relative war powers of the president and Congress from a historical perspective. He finds that the issue arose throughout U.S. constitutional history, and that the 1973 War Powers Resolution is consistent with early constitutional interpretations.

The original meaning of the Commerce Clause

Article Abstract:

Statements made during the drafting and ratification of the US Constriction are examined to determine the original meaning of the term 'commerce' as used in the Commerce Clause. The issue of whether the Clause should be narrowly interpreted is also discussed.
