The EU-U.S. compromise on the Helms-Burton and D'Amato Acts

Article Abstract:

The European Union and the US in May 1998 settled a dispute concerning the Helms-Burton and D'Amato Acts. The Helms-Burton Act strengthened the US trade embargo against Cuba and aided US nationals in obtaining compensation for property expropriated in Cuba. The D'Amato Act imposed sanctions on Iran and Libya for supporting terrorism. Both laws were widely criticized in Europe as violations of international law. However, the May 1998 compromise failed to answer many questions.

United States of America, home of the cheap and the gray: a comparison of recent court decisions affecting the U.S. and European gray markets

The author compares conflicting court decisions in the US and Europe affecting the importation of goods into a market without the permission of the trademark or copyright owner. Topics include the international exhaustion doctrine and the need for international cooperation regarding trade barriers.
