The benefits of ADR for medical malpractice; adopting contract rather than tort law

Article Abstract:

Arbitration of medical malpractice claims would greatly facilitate the adoption of contract rather than tort law as the legal basis for the claims, and contract along with grievance procedures and arbitration would be a superior dispute management system for health maintenance organizations' malpractice claims. The proliferation of the managed-care sector at the expense of the traditional fee-for-service sector creates an obligation for the dispute-resolution community to draw the attention of parties in the health care marketplace to the potential advantages of ADR.

Mediation programs for collegiate sports teams

Article Abstract:

Mediation can be as effective with athletes on a sports team as it is with workers in a corporation. Disputes that arise between athletes can hurt team performance. Coaches can select team mediators who can help resolve the disputes. Athletes should have formal training in developing listening and communication skills before participating in mediation. The entire team should be trained in mediation techniques.
