The debacle of corporate bankruptcy

Article Abstract:

Major changes in the current corporate bankruptcy system are proposed to provide management and investors with equal opportunities to recover their investments. One of the recommended changes is the elimination of the exclusive period in which only the management can file a plan of reorganization and the granting to creditors of the right to file a counter plan. Other proposed reforms include the granting of the right to change the venue for the filing of the plan by the creditors and the ability to force a vote to convert a reorganization case to a liquidation case without managerial or judicial intervention.
