Employment discrimination and private clubs: what is a bona fide private membership club?

Article Abstract:

Private clubs have exemption from the laws on discrimination in employment, but defining what a private membership club is has not always been easy. Moreover, clubs interested in expanding their memberships often take actions which jeopardize their private status. Club policies should be reviewed periodically to make sure that facilities are only used socially, that public use of facilities are restricted and that membership is capped. The Equal Employment Opportunity Commission lists certain requirements for a private membership club.

Federal and New Jersey state fair employment laws

Article Abstract:

The EEOC is charged with enforcing legislation prohibiting employment discrimination and provides a model for state agencies with the same duty. Accordingly, New Jersey has state versions of the major federal employment laws and the state's Division of Civil Rights within the Department of Law and Public Safety fulfills EEOC functions at the state level. The New Jersey equivalent of the Office of Federal Contract Compliance Programs is found in Governor Richard J. Hughes' Executive Order 12.
