The freedom of establishment and the market access of hospital operators

Article Abstract:

The questions relating to the permanent establishment of hospital operators in the European Union (EU) state that is not their home state are discussed. It is learnt that Member states enjoy considerable freedom in regulating national hospital markets without violating the freedom of establishment, which can be concluded from the Court's case law in the field of health care services, in which it shows great respect for the Member States' need to organize their hospital system in a way that allows careful planning of the available capacities to avoid 'any wastage of financial, technical and human resources.'

Critical analysis of the prospectus directive

Article Abstract:

The European Commission has radically changed the legal framework concerning he different operations related to the admission of securities to official stock exchange listing by means of the European Parliament and Council Directive 2003/71/EC of the 4, November 2003. A critical analysis is of the Directive is conducted, which suggests that there is still scope for developments of the existing text of the Directive, either through amendments of the text or by means of national implementing measures.

No flying start but a bright future of EU directive 2003/41/EC on occupational pension institutions

Article Abstract:

The European Union Directive 2003/41/EC on institutions for provisions of occupational retirement provision (now known as IORP- Directive or Directive) marks a significant step towards the setting up of a true internal market for the provision of occupational retirement benefits. The most relevant features of the Directive are presented and it is shown that pension provision in Europe has to be seen in a wider context within which tax matters are of particular importance.
