The rise of the whistleblower and the death of privacy: impact of 9/11 and Enron

Article Abstract:

The Sarbanes-Oxley Act of 2002 forbids employers from firing employees in return for reporting federal crimes. At the same time, the increased emphasis on preventing terrorism has caused law enforcement officials to demand increased cooperation from employers in investigating employees. Many employers are feeling squeezed between employee demands for more protection and also for privacy guarantees.

"To ends the most public and universal": an overview of the HIPAA privacy rule

The rules about privacy in medical records in the Health Insurance Portability and Accountability Act of 1996 may have wider significance, particularly in the field of labor law. The history of the privacy provisions is traced and the implications of the Bush administration's position on these provisions is discussed.
