The opinions of the International Court of Justice on the threat or use of nuclear weapons

Article Abstract:

The International Court of Justice is unsettled as to its opinion on the legality of nuclear weapon usage or threats under international law. The Court has expressly abstained from pronouncing on legal use of nuclear weaponry in reprisals against belligerents or extreme self-defense situations, nor has it pronounced on the legal status of deterrence policies. In reality, the Court's opinion would do little to reduce the possibility of nuclear warfare, since that can only be achieved through negotiation. However, opinions for the General Assembly and the World Health Organization could be useful in developing policy on this issue.

The revision of the Mines Protocol

Article Abstract:

The Review Conference for the United Nations Convention on Conventional Weapons did not prohibit the use of mines because the agreement would not be ratified by countries that use and make mines. However, the Conference did increase the scope of the Convention to include internal as well as international conflicts. Remotely delivered mines were restricted because of the high possibility for inaccurate placement. New detectability requirements were imposed on antipersonnel mines but not for antitank mines. Procedures for verification of compliance were also generated.
