The right to education under the South African Constitution

Article Abstract:

Section 29 of the South African Constitution includes a right to education. In light of this provision, the South African Constitutional Court should find that the country's education system is unconstitutional because of the low quality of some of its schools. This will help the nation attain positive socioeconomic outcomes in other areas if the decision allows the legislature sufficient discretion to address the problem.

Disaster in Durban: the United Nations World Conference Against Racism, Racial Discrimination, Xenophobia, and Related Intolerance

Article Abstract:

The United Nations World Conference Against Racism, Racial Discrimination, Xenophobia, and Related Intolerance held in Durban, South Africa in 2001 was an egregious failure. Political rhetoric dominated the debate to too great an extent and the process was not handled in an orderly fashion. The only value of the conference was that lessons may be learned concerning practices to avoid in international negotiation.

Judicial redistricting and the Article 1 state legislature

Article Abstract:

The US Constitution gives power to apportion election districts in a state "to the legislature thereof". This should be interpreted to refer to the legislative power of the state and not only the actual legislative body. Accordingly, courts should have power to redistrict when needed and when the legislative body is unwilling or unable to do so.
