The susceptibility of vertical restraints to summary adjudication: procedural avenues to substantive objectives

Article Abstract:

The courts' willingness to grant summary judgement in vertical restraint antitrust cases is discussed. Topics include the distinction between horizontal and vertical restraints, agreements between suppliers and dealers on restraints, per se price-fixing offenses, vertical nonprice restrictions and competitive effects, and challenges to complaints.
