'Things fall apart': The case for radical reform of the EU's courts

Article Abstract:

Industry's single market rights are being threatened by delays and backlogs in the EU courts. The courts are facing a deluge of cases and despite the concerns, member states are not proposing to do much to alleviate the problem. The Court of First Instance was set up to deal with staff and competition cases initially, and was extended to anti-dumping cases and to all cases against EU institutions, but both the European court of Justice and the Court of First Instance still face backlogs. The delays could result in the loss of commercial opportunities and it is possible that the quality of judgements will suffer.
