Timing is everything: potential economic repercussions of proposed "flextime" reforms to the FLSA overtime hours law

Article Abstract:

Proposed amendments to the Fair Labor Standards Act that would increase work hour flexibility by changing overtime requirements and allowing compensatory time in leu of overtime pay need to include worker protections. Employers under this version of the provisions are encouraged to force overtime on time-constrained workers and can make employees delay cashing out or using their compensatory time. To avoid these abuses, employers should have to pay interest on delayed credits, usage standards should be strict and mandatory overtime should be prohibited, among other protections.

Back injuries, OSHA general duty clause citations, and the NIOSH lifting guidelines

Article Abstract:

Back injuries account for a large portion of all lost work days and worker compensation costs, and as much as 49% of all low back pain stems from lifting. The National Institute for Occupational Safety and Health (NIOSH) lifting guidelines are discussed, along with the Occupational Safety and Health Administration (OSHA) enforcement guidelines and general duty clause citations. Employers should follow OSHA and NIOSH guidelines when implementing lift injury reduction programs.

Variable compensation plans, overtime calculations and the Fair Labor Standards Act

Article Abstract:

A variable compensation plan must contain a gainsharing or profit-sharing distribution formula that meets Fair Labor Standards Act requirements for calculating overtime pay. Whether distributions are includible in the regular rate of pay for overtime calculations must be determined and then how the rate will be calculated. Available exemptions, ways to avoid administrative problems, and distribution formula guidelines are described.
